“New Atlantis” Constitution

We, the undersigned citizens, Vladimir Yordanov Balanov, born on the 22.08.1957 in Svishtov, Bulgaria, Galina Lefterova Balanova, born on the 15.02.1959 in Svishtov, Bulgaria and Yordan Vladimirov Balanov, born on the 31.05.1980 in Svishtov, Bulgaria declare the foundation of an independent, sovereign country, named “New Atlantis”, that shall be a constitutional monarchy and principality, and shall be committed to the rule of law.

The sovereign country consists of the entire territory of the formed in 2012 floating island of “YJNI”. As of its inauguration, the country has an area of 26800 m2 It is located in the South of the Pacific Ocean at 38° degrees south and 168° degrees and 16’ minutes west within the adjacent territorial waters and the exclusive economic zone around the island of “YJNI”.

The purpose of the foundation of “New Atlantis” shall be to combine the economic potential that the island has to offer as a country with the intellectual capacity of the world’s most intelligent people. They would in turn contribute to the wellbeing of not only the Principality’s citizens, but also those of planet Earth, in the spirit of their predecessors in the Ancient Atlantida, wherefore we are adopting the present Constitution. 

Chapter One 

Article 1.1.: The citizens of New Atlantis and the foreigners legally residing on its territory, including the land, water, air and virtual space, shall be entitled to the rights proclaimed by the 1948 Universal Declaration of Human Rights and elaborated on by the 1966 International Covenant on Civil and Political Rights and the 1966 International Covenant on Economic, Social and Cultural Rights. The legislative, executive and judiciary powers of the country shall extend these rights in their activity. 

Article. 1.2.: All shall be entitled to a dignified life and physical safety. The right to personal freedom is inviolable. It can only be limited by statute in the name of common interest.
            Par. 1.: All shall be entitled to an uninhibited personal development, so long as the rights of others are not infringed upon.
          Par. 2.: All shall be equal before the law. No one shall be discriminated based on gender, origin, race, language, religion or religious beliefs. 
          Par. 3.: All citizens shall have the right to freely choose their occupation. No one shall be coerced to execute a certain job. The execution of a profession can be regulated by statute.

Chapter Two

Art. 2.1.: Bulgarian, English and Russian shall be used as official languages. 

Art. 2.2.: The Head of State of “New Atlantis” shall be the first citizen to have participated in its inauguration and to have personally signed the present Constitution. He shall bear the title of a “Principal” and shall hold the supreme power in the country. The supreme power shall be handed over to his first born son who is also its legal heir. It is allowed for one of the following two in line of succession to be proclaimed a sovereign. If the initially appointed heir or one of the following two in line of succession are not capable to assume the supreme power, the Advisory Board shall make the final decision on the matter. In the case of equal votes by the members, the Chairperson of the Advisory Board shall have casting vote.

Art. 2.3.: The Advisory Board shall consist of a Prime Minister, the Chairperson of the National Academy of Science, all Ministers, the Chairperson of the State Central Bank, the Chairperson of the Supreme Court, as well as the persons appointed with a decree by the Sovereign. The Chairperson of the Advisory shall be the Prime Minister. The functions of the Advisory Board shall be to discuss nationwide problems and to present resolutions to the Sovereign. The Advisory Board shall be assembled by the Sovereign or his Prime Minister, shall be sitting on predefined subjects and agenda, and shall be making decisions based on a simple majority. 

Art. 2.4., Par. 1.: The Head of State shall have exclusive jurisdiction over taxes, imposts, revenue taxes, concessions and monopolies. The revenue from these sources shall be regulated by statute, approved by the Sovereign and the Minister of Finance and Economics following a coordination with the remaining members of the Advisory Board. Any changes in the legally defined amount of taxes and concession fees shall be made by the Sovereign upon request by the interested party pertaining to a specific case or all cases within a fixed period of time.
        Par. 2.: The collection of taxes and imposts shall be executed by the Ministry of Finance and Economics. An audit of this activity shall be executed by qualified personnel, authorised by the Sovereign.
       Par. 3.: Income from sources defined in Art.1 shall be distributed among the Sovereign, the National Academy of Science, the Central Bank and the Supreme Court. The ratio of distribution shall be determined by a joint legislative proposal by the Ministry of Finance and Economics and the Chairperson of the State Central Bank, and shall be approved by the Sovereign in coordination with the remaining members of the Advisory Board.

Chapter Three

Art. 3.1.: The citizens of the “New Atlantis” Principality shall be all persons to have recognized the present Constitution and the legislation of the Principality and to have been accepted as citizens with a decree by the Head of State. By statute the citizens of the “New Atlantis” Principality shall be the persons who have participated in the foundation of the country and who have personally signed the present Constitution.
       All Nobel laureates, Nobel nominees, all Mensa members who have submitted a written request to the Sovereign or the persons who have inaugurated the Principality shall be by right citizens of the “New Atlantis” Principality.
        The Head of State shall indicate their names in a decree.

Art. 3.2.: Persons not included in the previous article shall receive citizenship with a decree by the Head of State addressed to the Minister of Justice as a response to a written request on their part. The same procedure shall be applied in the case of dismissal from citizenship. 

Art. 3.3.: The dismissal of citizenship in the previous article shall only be allowed in the case where the individual being deprived is not left without any citizenship. The Head of State can divert from this provision if he deems this deprivation in the best interest of the citizens of the “New Atlantis” Principality. 

Art. 3.4.: No citizen of the “New Atlantis” Principality shall be extradited for experimenting or serving sentence upon request of another country, unless the extradition is authorized by the Head of State with a written decree to the Minister of Justice.

Chapter Four

Art. 4.1.: The Constitution shall represent the supreme law. The common legislation and legal regulations, as well as individual administrative articles must not be of contradiction. The citizens can request them to be aligned in accordance with the provisions of the Constitution. 

Art. 4.2., Par. 1.: The Head of State shall approve the laws upon request by the Advisory Board. The main legislation, regulations for law application and provisions for partial law application issued by the respective ministers, as well as rules and regulations, indicated as “Statute”, shall be immediately published in an Official Print Entity and/or the country’s official website. The legal and regulatory articles shall become effective three days after their promulgation, unless stipulated otherwise in the respective law or regulatory enactment.
        Par. 2.: The indicated as part of national law, approved legal and regulatory articles shall be published prior to being entered in the State Register. 

Art. 4.3.: Until the creation of its own legislature, The “New Atlantis” Principality shall apply the Bulgarian civil, commercial, criminal and international private law. 

Art. 4.4.: When concluding an arbitrary agreement for resolving international conflicts, The Head of State can agree upon an arbitration by applying a national legislation other than the legislation stipulated in Art. 4.3. 

Chapter Five

Art. 5.1., Par. 1.: The Council of Ministers shall have the following Ministries:

a) Ministry of Foreign Affairs 
b) Ministry of Justice
c) Ministry of Economics and Natural Resources 
d) Ministry of Finance
e) Ministry of Internal Affairs and Development
f) Ministry of Maritime Transport 
g) Ministry of Science, Culture and Communication 

The Head of the Council of Ministers shall be the Prime Minister who shall be in charge of governing and coordinating the activity of the different Ministries. He shall be supported in his duties by the Deputy Prime Minister. 
If necessary, the Head of State shall create Ministries executing other national activities. 
The Head of State shall appoint and dismiss with a decree the Prime Minister, the Deputy Prime Minister and the Heads of the Ministries (The Ministers.) It is permitted for the Prime Minister and his Deputy to govern different Ministries simultaneously. The positions of Prime Minister and all other Ministers shall become effective as of the day they pledge allegiance. 
        Par. 2.: The Prime Minister, his Deputy and every Ministry shall create their own rules for organizing labor, including regulations for negotiation and conclusion of agreements that become effective upon their approval by the Head of State. 

Art. 5.2., Par. 1.: The official currency of the “New Atlantis” Principality shall be the principal dollar “Atlant”, the value of which shall be equal to 1/1000 of the current value of one ounce of gold. The principal dollars can be in the form banknotes, coins or electronic money. The issuing of electronic principal dollars, the printing out of banknotes or the mintage of coins shall be executed in accordance with a decree by the Head of State.

Par. 2.: The Head of State shall appoint and dismiss with a decree the Chairperson of the State Central Bank, that shall regulate all activity pertaining to issuing, emitting or withdrawing money, crediting and licensing, currency security, international payments and clearing systems with other countries. The Central Bank and its Chairperson shall work in accordance with the rules administered by the Sovereign. The position of the Chairperson of the State Central Bank shall becomes effective after pledging allegiance to the Sovereign.

Art. 5.3., Par. 1.: A national police force shall be created to maintain the public order and security that shall be under direct supervision and control of The Minister of Internal Affairs and Development. 

Par. 2.: The police must acknowledge the right of all citizens to free mobility within the territory of the country. Limitations on that right shall only be determined by statute when national security is concerned, in preventing of epidemies or avoiding natural disasters. 

Par. 3.: The State shall safeguard the property and inheritance right of all citizens, as well as the right for protection against violation on their property, including from the police. Limitations on these rights shall only be administered by statute based on one of the premises referred to in the second sentence of the previous paragraph. 

Art. 5.4.: The country shall not provide a refuge to an individual who is avoiding justice. 

Chapter Six 

Art. 6.1.: First instance courts shall be created with a decree by the Sovereign in as many country regions as necessary in order to have a functioning justice system. The Head of State shall appoint judges to them among the citizens of the “New Atlantis” Principality who have a higher legal education and an acknowledged judiciary capacity. The positions of the appointed judges shall become effective as of the day they pledge allegiance to the Head of State and shall be terminated as of the date of the respective decree.
        Par. 1.: The supreme court shall be organized into two divisions. One of them shall discuss and decide on administrative and criminal proceedings as a second instance and on constitutional proceedings as a first instance. The other division shall discuss and decide on civil and commercial proceedings as a second instance. Decisions by the Supreme Court shall not be subject to appeal. The Chairperson of the Supreme Court who is also a member of the Advisory Board shall be appointed and dismissed with a decree by the sovereign. His position shall become effective after pledging allegiance. 
       Par. 2.: The Head of State shall appoint the Supreme Judges among the citizens of the “New Atlantis” Principality who must be at least two individuals in each division that apart from a higher legal education and an acknowledged judiciary capacity must also possess a minimum of ten years of working experience. Thereof, the positions of the appointed judges shall become effective as of the date of pledging allegiance and shall be terminated as of the respective decree date. 

Art. 6.2.: Every citizen, legal entity or foreigner in the country can present an official appeal to the court to protect his right to personal property from violation or threat of violation. 

Art. 6.3.: An individual can be convicted or punished when guilty of an act if this act has be defined as criminal prior to the execution of the act. 

Chapter Seven

Art. 7.1.: The State symbol shall be the National Flag. It has a rectangular form. It is red in the upper triangle half and blue in the lower triangle half. There is a white diagonal line connecting the red and blue triangle of the flag.

Art. 7.2.: With the adoption of the present Constitution a new country shall be founded that is a Principality and bears the name of “New Atlantis”. The country shall execute its sovereignty over the territory of 26 800 m2 of the floating island of "YJNI", the territorial waters within 12 nautical miles in the proximity of the island and the newly formed exclusive economic zone within 200 nautical miles in the proximity of the island, as well as the air space of both the island and its territorial waters. 

Art. 7.3.: All natural recourses located in the recesses of the territorial waters including the economic zone as well as the recesses of the island itself shall be an exclusive state property of the Principality. Their extraction and exploitation shall to be executed in accordance with regulations determined by the Head of State. 

Art. 7.4.: The principal can allow the building of artificial structures In the territorial waters and the exclusive economic zone of the Principality. These may be floating platforms and industrial islands, as well as foundations for cities that can receive governing autonomy with their own tax policy. 

Art. 7.5.: The individuals participating in the foundation of the country, “New Atlantis” Principality” are:
- Vladimir Yordanov Balanov, born on the 22.08.1957 in Svishtov, Bulgaria, 
- Galina Lefterova Balanova, born on the 15.02.1959 in Svishtov, Bulgaria 
- Yordan Vladimirov Balanov, born on the 31.05.1980 in Svishtov, Bulgaria 

and by the power of article 2.2. of the present Constitution they agree that the first participant in the inauguration of this country to have signed the Constitution, Vladimir Yordanov balanov, shall be the Head of State and Sovereign of the new country, the “New Atlantis” Principality, and shall bear the title “Principal”. 

Art. 7.6.: The present Constitution shall be effective as of:
а) its signing by the founders and the date of its issuing in an Official Print Entity and/or the official website of the “New Atlantis” Principality
b) as of the date of its signing by the founders that is legalized by a notary.

Art. 7.7.: If necessary, the Constitution can be revisited and updated with a decree from the Sovereign requested by the Advisory Board.
